1. Introduction

These Terms govern the voice-banking and voice-cloning services of MindSpeller BCI BV. They do not authorise use or supply of the investigational MindSpeaker/MindClick configuration for routine patient communication. Research participation and any research-device supply require separate written arrangements, participant information and the applicable regulatory, ethics and consent requirements.

Scope clarification — 10 September 2026: A website enquiry, prototype-demonstration booking or acceptance of these voice-service terms is not study enrolment or consent to collect participant EEG or health information.

2. Definitions

• • “Company” refers to MindSpeller BCI BV, headquartered at Duigemhofstraat 101, 3020 Herent, Belgium (BE 0749.699.835).
  • “User” refers to the individual whose voice data is recorded and processed, or their legal guardian in applicable cases.
  • “Services” refer to the biometric data storage and voice cloning solutions provided by the Company.
  • “Biometric Data” refers to personally identifiable data obtained through voice recordings or EEG readings, which uniquely identify an individual.

3. Consent for Data Processing

Where explicit consent is the lawful basis for processing your data, it must be requested and recorded through a separate affirmative consent process before the relevant processing starts. Merely browsing the website, booking a demonstration, using a service or accepting these Terms does not by itself constitute explicit consent. Optional research, model training and marketing must be distinguished from processing necessary for the selected service.

4. Rights and Ownership

By agreeing to these Terms, you grant the Company a non-exclusive, worldwide, royalty-free license to store, process, and use your Biometric Data for the purpose of providing our Services. The Company will not share your Biometric Data with third parties without your explicit consent, except where required by law.

5. Data Security and Retention

We implement industry-standard encryption and security protocols to protect your data. While we take all reasonable measures to ensure data confidentiality, we are not responsible for:

• • Unauthorized access due to cyberattacks or security breaches outside of our control.
  • Data loss during network transmissions.
  • Errors or misconduct by third-party service providers involved in storage or processing.
  • Acts of force majeure, such as natural disasters or technical failures beyond our control.

Users remain responsible for securing their own devices and maintaining the confidentiality of their account credentials.

6. User Identification

To use our Services, you may be required to provide accurate personal identification details, including:

Providing false or misleading information may result in the suspension or termination of your account.

7. Termination of Services

You may terminate your agreement and request the deletion of your data at any time by contacting us at contact@mindspeakerbci.com. Upon termination, all stored data associated with your account will be deleted, unless required by law to be retained.

8. Applicable Law and Jurisdiction

These Terms are governed by the laws of Belgium and the European Union. Any disputes arising from the use of our Services will be subject to the exclusive jurisdiction of the Belgian courts.
